These Terms and Conditions (the “Terms”) govern your access to and use of the Gondli platform operated by Gondli AG(“Gondli”, “we”, “us” or “our”). By creating an account or using our website and services (the “Services”), you agree to these Terms.

Gondli is a marketplace that connects customers (“Customers”) with independent wellness and health service providers (“Providers”). Please read these Terms carefully.

1. About Gondli and these Terms

The Services are provided by Gondli AG, [Street and number], [Postal code] [City], Switzerland (UID: CHE-XXX.XXX.XXX). These Terms form a binding agreement between you and Gondli. If you use the Services on behalf of a business, you confirm you are authorised to bind that business.

2. Our role as an intermediary

Gondli acts solely as an intermediary platform that enables Customers to discover and book services offered by independent Providers. The service contract for any booking is concluded directly between the Customer and the Provider. Gondli is not a party to that contract and is not the provider of the wellness, therapy or health services.

Providers are solely responsible for the services they offer, including their quality, legality, licensing, safety and any professional or medical advice given.

3. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Services. You agree to provide accurate information, keep your account credentials confidential and be responsible for all activity under your account. Notify us promptly of any unauthorised use.

4. Bookings

When you book a service, you make an offer to the relevant Provider. A booking is confirmed once the Provider (or the platform on the Provider’s behalf) accepts it. Details of availability, pricing and the scope of each service are set by the Provider and shown at the time of booking.

You agree to attend or use booked services as arranged and to comply with the Provider’s reasonable instructions and house rules.

5. Prices and payment

Prices are shown in Swiss francs (CHF) and, where applicable, include Swiss VAT. Depending on the Provider, payment may be made online via our payment provider (Stripe), by invoice, or directly to the Provider at the place of service.

Where payments are processed online, you authorise us and our payment provider to charge the applicable amount using your selected payment method. Gondli may charge Providers a service or commission fee, as separately agreed with Providers.

6. Cancellations, changes and refunds

Cancellation and rescheduling conditions are set by each Provider and shown at the time of booking. Refunds, where due, are handled according to the applicable cancellation policy and processed through the original payment method. Statutory rights that cannot be excluded under Swiss law remain unaffected.

7. Additional terms for Providers

If you use the Services as a Provider, you additionally agree that:

  • you offer your services lawfully and hold all required licences, qualifications and insurance;
  • your listings, availability, pricing and content are accurate and kept up to date;
  • you are responsible for delivering booked services and for your tax and social-security obligations;
  • you comply with applicable data protection law in respect of Customer data you receive.

8. Acceptable use

You agree not to:

  • use the Services for any unlawful, fraudulent or harmful purpose;
  • post false, misleading, offensive or infringing content, or impersonate others;
  • circumvent the platform to avoid fees, or attempt to disrupt or gain unauthorised access to the Services;
  • collect or misuse other users’ personal data.

9. User content and reviews

You retain ownership of content you submit (such as reviews, photos or listings) and grant Gondli a non-exclusive, worldwide, royalty-free licence to use, host and display it for the purpose of operating and promoting the Services. You are responsible for your content and confirm you have the rights to share it. Reviews must be genuine and based on actual experiences.

10. Intellectual property

The Services, including the Gondli name, logo, software and design, are owned by Gondli or its licensors and protected by intellectual property law. Except as expressly permitted, you may not copy, modify, distribute or create derivative works from the Services.

11. Third-party services

The Services may integrate with third-party services (for example payment processing via Stripe and calendar synchronisation via Google Calendar or Microsoft Outlook). Your use of those services is subject to the relevant third party’s terms and privacy policies, for which Gondli is not responsible.

12. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the extent permitted by law, Gondli does not warrant that the Services will be uninterrupted or error-free, and makes no warranties regarding the services offered by Providers.

Gondli does not provide medical advice. Information available through the Services is not a substitute for professional medical or health advice.

13. Limitation of liability

To the extent permitted by Swiss law, Gondli is liable only for damages caused by intent or gross negligence. Liability for slight negligence, for indirect or consequential damages, and for the acts or omissions of Providers is excluded. Mandatory statutory liability, including for death or personal injury where it cannot be excluded, remains unaffected.

14. Suspension and termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or where required by law. Provisions that by their nature should survive termination will continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new “last updated” date and, where changes are material, provide notice through the Services. Continued use after changes take effect constitutes acceptance.

16. Governing law and jurisdiction

These Terms are governed by Swiss substantive law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for any disputes is Switzerland, subject to any mandatory place of jurisdiction provided by law (for example for consumers).
